Swarup Kumar is a seasoned IP Attorney, registered Patent Agent and Managing Partner of Kumar & Sardana Associates (KSA) with over two decades of experience in intellectual property law and practice. Prior to establishing KSA, he was an Equity Partner at Remfry & Sagar. He has worked closely with Fortune 500 multi-nationals as well as small and medium enterprises building their IP portfolio (Patent, Trademark, Design etc.), protecting, defending and enforcing their IP rights. Swarup counsels clients, associates, as well as in-house IP heads/attorneys of reputed multinational and national companies, SMEs and start-ups including from India, EP, US, JP, AU, CA, KR and CN on critical IP matters.

Swarup’s core specialization lies in handling and/or supervising, inter alia, drafting of patent specifications, filing and prosecution of cases across all technology verticals, working of patents, renewals etc. He regularly renders opinion and/or advice on IP matters including on patentability of inventions, freedom to operate (FTO), assignments and licensing of inventions, searches, oppositions, revocations as well as patent litigation. Swarup has prosecuted and supervised prosecution of thousands of patent applications in the last 20 years or so. He is also experienced in dealing with high-stake erstwhile Appellate Board (IPAB) and Court matters – filing appeals, writs etc., and acting as briefing counsel, appearing as arguing counsel before requisite forums.

Besides supervising searches, preparation, filing and prosecution of Design and Trademark matters, Swarup is adept in dealing with TM opposition and Design Cancellation.

Swarup is currently Deputy Secretary General (DSG) of FICPI International – elected for the second consequtive term in Naples, Italy. FICPI is the world’s leading international organization for IP attorneys in private practice with over 6000 members. Swarup is one of the founder members of FICPI-India – elected as the Secretary thereof since 2015 until recently as well as the Exco Delegate from India. He is, at present, the elecetd President of FICPI-India. He also acted as the Chair of CET 7 (Enforcement & ADR) group since June, 2018 until getting eleceted as DSG. On behalf of FICPI, he collaborates with and meets representatives of the IPO, JPO, KIPO, EPO, USPTO, CNIPA and DIPP on strategic matters. Swarup is also the Chair of the Life Science Comittee of Licensing Executive Society (LES) India and an elected Executive Committee Member thereof. 

Swarup has published several peer reviewed papers, articles, pieces about IP (Patent) law and practice in Intellectual Property Magazine (IPM), LSIPR, IP Watch, SCRIPTED, FICPI Website etc. Attended/attends various reputed IP conferences including INTA, FICPI, APAA, AIPPI, MARQUES, AIPLA, BIPF etc.

Swarup is invited to speak regularly on IP Law and Practice Management at national and international platforms such as FICPI-International & India, LES, BRICS-IP Forum, FICPI-China etc.

Swarup has a Master’s degree in Chemistry, a Bachelor’s degree in life Science from DU, a Master’s Degree in Law, a Bachelor’s degree in Law from DU and a Diploma in IP from ILI. Besides being an Advocate, he is a registered Patent Agent with the IPO.
